(ORAL) Learned counsel for the appellant submits that he may be permitted to withdraw the appeal with liberty to move the State Empowered Committee bringing to its notice the fact that the appellant has already been exonerated, in respect of similar complaint, in the departmental proceedings as well as investigation and inquiry conducted by the police and other authorities and request the State Empowered Committee to consider the same while taking a decision in the matter.

Prayer made is allowed.

The appeal stands dismissed as withdrawn with the aforesaid liberty.
