(ORAL) This petition has been filed under Article 226 of the Constitution of India for issuance of directions to the official respondents to protect the life and liberty of the petitioners from the hands of respondents No. 5 to 11.
Learned counsel for the petitioners submits that the official respondents are trying to involve petitioner No. 4 in a false case and have been raiding the house of the petitioners.
Status report dated 08.10.2020 by way of affidavit of Deputy Superintendent of Police, Yamuna Nagar-I has been filed and the same is taken on record. As per the status report, inquiry was conducted in the present case and FIR No. 86 dated 26.6.2020 under Section 379-B IPC has been registered at Police Station Buria in which, Pardeep alias Banda and Dhani Ram have been arrested. CRWP No. 6212 of 2020 -2investigation is complete and final report has been prepared. Moreover, during enquiry on the complaints moved by Hussain and his father, Ahsanpetitioner No. 2 and Husain-petitioner No.4 have got recorded their statements wherein they stated that they have given the complaint under the influence of someone and no such occurrence took place. Learned counsel for the petitioners submits that since as per the status report, the petitioners have not been involved in the above said FIR, he does not want to press the present petition. He, however, submits that liberty may be granted to the petitioners to re-open the matter in case there is some grievance against the official respondents. Keeping in view the above, the present petition has become infructuous and is disposed of accordingly.
