The petitioner seeks the concession of regular bail in a case of recovery of 600 grams of heroin, pistol and 35 live cartridges from Amolakh Singh and 500 grams of heroin along with Rs. 2.50 lacs recovered from Harpal Singh on the basis of secret information from an apartment in Ludhiana.
So far as the petitioner is concerned,the allegation against him is that the apartment from which the recovery was effected had been taken on rent by the petitioner and that the petitioner had helped his coaccused Amolakh Singh and Harpal Singh to get the rented accommodation.
With the assistance of ASI Amarjit Singh and learned State counsel, I have gone through the police file in order to prima facie establish the culpability of the petitioner. Statement of Sarpanch Shivraj appears to have been recorded u/s 161 Cr.P.C. The said witness is alleged to have seen the petitioner and Amolakh singh selling 250 grams of heroin to some unknown persons on an unspecified day, date and time. On the basis of the prima facie evidence collected regarding the culpability of the petitioner, the involvement and connivance of the petitioner with coaccused appears to be debatable. The petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail bonds/ surety bonds to the satisfaction of the Special Judge/ Area Magistrate, Ludhiana.
