Versus

State of Punjab

...Respondent

CORAM: HON'BLE MR. JUSTICE SUDHIR MITTAL

Present:

Mr. Fateh Singh Bhullar, Advocate, for the petitioner. *** SUDHIR MITTAL, J. (ORAL) The petitioner seeks anticipatory bail in FIR No.44, dated 16.04.2023, registered at Police Station Valtoha, District Tarn Taran, under Section 61 of the Punjab Excise Act, 1914.

2.

FIR aforementioned was registered on receipt of secret information. Raid was conducted and recovery of 350 litres of lahan was made. The petitioner allegedly ran way from the spot. 3.

Vide order dated 05.05.2023, the Additional Sessions Judge, Tarn Taran granted interim bail to the petitioner with directions to join investigation on 10.05.2023. However, the petition was dismissed vide order dated 10.05.2023 as the petitioner did not join investigation. 4.

Learned counsel for the petitioner has submitted that a certified copy of order dated 05.05.2023 was received only on 09.05.2023. For this reason, he was unable to join investigation on 10.05.2023. 5.

The explanation, on the face of it, is absurd. Certified copy of the order had already been received a day earlier not a day later and thus, the explanation is illogical.

6.

Since the petitioner did not join investigation despite interim bail having been granted by the Additional Sessions Judge, Tarn Tarana, he does not deserve any concession from this Court. 7.

The petition is accordingly dismissed.
