(Oral) Since both these petitions are arising out of one and the same FIR, the same are being disposed of together. The allegations against the petitioners are that petitioner Ajit Singh alleged to be owner of plot measuring 100 sq. yards sold the same to Rakesh petitioner on 8.3.2010 who subsequently on 11.3.2010 sold the same DALBIR SINGH TIWANA 2015.04.30 09:34 I attest to the accuracy and authenticity of this document High Court, Chandigarh

Criminal Misc. Nos. M-8473 and M-12433 of 2015 -2very property to complainant Sumitra for Rs 11,75,000/- and in the agreement to sell they intentionally put a wrong date and has devised a plan interse between themselves to sell the same very property on 7.10.2014 and thus fraudulently by this deceivement stripped the complainant of her valuable money though it is submitted on behalf of the petitioners by their counsel that a civil suit is pending between the parties and that it is a purely civil dispute and there is inordinate delay in registering the FIR. Counsel for the petitioners finding that the Court was not inclined to grant bail, have made statement at this stage to withdraw both the petitions. Allowed to do so.

Both the petitions are dismissed as withdrawn. ( Fateh Deep Singh ) April 28, 2015 Judge 'tiwana'
