This petition has been filed under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.538 dated 14.9.2018 registered for the offences under Sections 323, 324, 506 and 34 IPC and (Section 326 IPC, which was added later on) at Police Station City Yamuna Nagar, District Yamuna Nagar.
Notice of motion has been issued in this case. Mr. Tanuj Sharma, learned Assistant Advocate General, Haryana has put in appearance on behalf of the respondent-State and contested this petition.
I have heard learned counsel for the petitioner and learned State counsel appearing for the respondent-State and have gone through the record.
As per the prosecution version, the present petitioner is named HARPAL SINGH PARMAR 2018.12.15 14:54 I attest to the accuracy and authenticity of this document Chandigarh
Cr. Misc. No.M-49558 of 2018 [2] in the FIR and he was stated to be armed with a `Patla' and grievous injuries were given on the fingers.
Learned counsel for the petitioner argued that an FIR was already registered against the complainant side as they were teasing the girl in the relation of the present petitioner and the present petitioner has been falsely implicated in this case by those accused. I have gone through the record and find that the present petitioner has already joined the investigation. As stated he is not required for any custodial interrogation. No useful purpose will be served by sending the petitioner to custody.
Keeping in view the facts and circumstances of the present case; without discussing the facts in minute detail and without expressing any opinion on the merits of the case, I find merit in this petition and the same is allowed. The interim order dated 20.11.2018 passed by this Court granting interim bail to the petitioner is made absolute. However, the petitioner shall join the investigation as and when called upon to do so and shall abide by the conditions of Section 438 (2) Cr.P.C. December 14, 2018.
