RAMESHWAR SINGH MALIK, J Petitioner seeks bail pending trial in FIR No.109 dated 21.4.2007 under Sections 452,324,148,149 IPC, registered at Police Station City, Phagwara. Learned counsel for the petitioner submits that petitioner is inside the jail for the last about 3 months. He undertakes to appear on each and every date before the learned trial court. He further submits that when the petitioner was declared proclaimed offender, he was out of India and could not come to know about the proceedings against him, but earlier he was declared innocent by the investigating agency. Thus, he prays for allowing the present petition. Notice of motion.

On the asking of the court, Mr.D.S. Virk, AAG, Punjab, accepts notice.

Crl.Misc. No.M-8491 of 2015 Singh, Police Station City, Phagwara, submits that it is a matter of record that the petitioner remained proclaimed offender for a period of seven and half years. He belongs to the State of Bihar and there is every apprehension that he will again absent from attending the court proceedings. Since the petitioner remained proclaimed offender for more than 7 years, he is not entitled for bail pending trial. At this stage, learned counsel for the petitioner seeks permission of the court to withdraw the present petition.

Permission is granted.

Dismissed as withdrawn.
