The instant petition has been filed under Section 483 of BNSS, 2023 (earlier Section 439 Cr.P.C.), for grant of regular bail to the petitioner, during the pendency of trial, who has been booked in a criminal case arising out of First Information Report, as detailed hereunder:- Name of Petitioner(s) FIR No. Date Section(s) Police Station District 03.01.2025 21/61/85 of NDPS Act (Section 29 of NDPS Act added later on) City Ferozepur Ferozepur Vishal @ Bhola, aged 24 years 2.
On the basis of secret information, raid was conducted and thereupon, car bearing No. DL-4C-AT-0522 was intercepted. From the right pocket of black lower of co-accused Rahul 358 grams of Heroin was recovered. Petitioner-Vishal @ Bhola was driving the said car, however, no recovery was effected from him. 3.

CRM-M-21368-2026 already convicted in NDPS case and is involved in total five cases and three of those are under the NDPS Act.

No ground for grant of bail is made out at this stage. Therefore, present petition is dismissed at this stage.
However, it would be open for the petitioner to move fresh bail petition after sufficient incarceration, but not before the period of four months, if trial does not finish.
