Counsel for the petitioner is required to satisfy this court regarding the maintainability of this petition u/s 482 Cr.P.C. and as to why a revision petition could not have been filed against the order summoning the petitioner as an accused.

At this stage counsel for the petitioner submits that he has got instructions to withdraw the petition with liberty to avail the remedy of revision by approaching the Sessions Court.

Dismissed as withdrawn with the aforesaid liberty. It will be open to the petitioner to take the benefit of Section 14 of the Limitation Act. The petitioner will also be at liberty to raise all the pleas, taken up in this petition, at an opportune time.
