(ORAL) Learned counsel for the petitioner wants to withdraw the present petition in case, the petitioner/accused be exempted from personal appearance before the trial Court as she has two minor children and is suffering from ailment. The prayer being innocuous, the same is allowed. Given above, the present petition is disposed of having been withdrawn and this Court requests the trial Court to be very sympathetic while considering the application for exemption from personal appearance, in case, she files such an application. It is clarified that petitioner shall not seek exemption at the time of framing of charges and for recording of statement under Section 313 Cr.P.C. She will be permitted to appear through her counsel.
