RAMENDRA JAIN, J. (ORAL) Custody certificate filed in Court today is taken on record. Through this petition under Section 439 Cr.P.C. prayer has been made for grant of regular bail to petitioner in a case arising from FIR No.48 dated 06.04.2016 registered under Sections 379-B and 411 IPC at Police Station Sadar, District Amritsar, Punjab. According to the prosecution, in the early morning of 03.04.2016 two unknown persons robbed the complainant for `500/-, two mobile phones and other articles while he was travelling in an auto-rikshaw. Learned counsel inter alia contends that petitioner was not named in the FIR. He has falsely been implicated on the basis of disclosure statement of co-accused Bunty in another FIR. Petitioner is in custody since 08.06.2018. Conclusion of trial may take a sufficient long time. No useful purpose would be served by keeping the petitioner in jail any more. Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Consequently, petitioner is ordered to be released on bail, on his furnishing bail bonds and surety bonds to the satisfaction of Trial Court/Duty Magistrate concerned.
