Prayer in this writ petition filed by the petitioner under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of mandamus, directing the respondent - authorities to consider the candidature of petitioner and appoint the petitioner against the vacant post of Assistant Engineer/On Training (Electrical) advertised by respondent - authorities vide advertisement No.CRA-10/2021, dated 22.04.2021 (Annexure P-2). Further prayer has been made to issue direction to the respondent - authorities to keep at least 01 vacant post of Assistant Engineer/On Training (Electrical) available for the petitioner by not finalizing the selection process or in alternative not to carry over the 01 vacant post of Assistant Engineer/On Training (Electrical) to any future selection/advertisement that may be made/issued during the pendency of the writ petition. CWP No.11758 of 2024 (O&M) deemed date of appointment to the petitioner on the vacant post of Assistant Engineer/On Training (Electrical) from the date on which the last candidate (in General category) in merit joined on the said post. 2.

Learned counsel for the petitioner, at the very outset, confines his prayer for deciding legal notice dated 03.04.2024 (Annexure P-18). He submits that at this stage, petitioner would be satisfied, if the said legal notice is decided by passing a speaking order within a time bound frame.

Mr. Rajesh Sehgal, Addl. A.G., Punjab, accepts notice on behalf of the respondents and has no objection to the innocuous prayer made by learned counsel for the petitioner.

I have heard learned counsel for the parties and have gone through the record of the case.

Without going into the merits of the case at this stage, the present petition is disposed of with a direction to respondent No.2, to decide legal notice dated 03.04.2024 (Annexure P-18), expeditiously submitted by the petitioner by passing a speaking order, preferably within a period of 02 months from the date of receipt of certified copy of this order.
