RAMENDRA JAIN, J. (ORAL) Prayer in the instant petition under Section 439 Cr.P.C. has been made for grant of regular bail to petitioner in a case arising from FIR No.14 dated 29.03.2019 registered under Sections 22 of the Narcotic Drugs and Psychotropic Substances, 1985 at Police Station Kheri Naudh Singh, District Fatehgarh Sahib.
Petitioner is facing trial in aforesaid FIR for alleged recovery of 900 Lomotil tablets, which falls under the category of "commercial quantity".
Learned counsel for the petitioner inter alia contends that FSL report has not yet been received. Therefore, it cannot be said at this stage that alleged recovery was a narcotic substance. Petitioner is in custody since 29.03.2019.
In view of above, but without expressing any opinion on the merits of the case, the petitioner is granted interim bail subject to furnishing RAVINDER SINGH 2019.05.29 11:59 I attest to the accuracy and integrity of this document personal bonds and two sureties of ` 2.00 lakh each, to the satisfaction of
