(Oral) The above-named Deputy Superintendent of Police as well as the Investigating Officer of the case have appeared in the Court today, in compliance of the order passed by this Court on 17.12.2021. Short reply filed on behalf of the respondent-State, by way of the additional affidavit of Deputy Superintendent of Police, Sub Division City Batala, Police District Batala, is already available on the file and the same is taken on the record.
However, learned counsel for the petitioner seeks permission to withdraw the instant petition, while submitting that in view of the contents of para No.11 of the said additional affidavit to the effect that the petitioner has committed the offence under Section 201 IPC and he is POOJA SHARMA 2022.02.25 16:39 I attest to the accuracy and authenticity of this document
CRM-M No.30014 of 2021 (O&M) -2not an accused under the NDPS Act, the petitioner will avail the remedy, as may be permissible to him under law, for seeking the relief as claimed in the present petition.
Learned State counsel has no objection in the withdrawal of this petition.
Resultantly, the petition in hand stands dismissed for having been withdrawn.
