20 grams of heroin in a polythene envelope from the shoes of accused-petitioner was recovered inside the jail whilel being in custody in another case. Petitioner was enlarged on bail vide order dated 22.8.2014 in the aforesaid FIR. Due to his non-appearance on 21.7.2015 his bail bonds were cancelled and he was declared a PO on 4.1.2016.

CRM-M 7537/2016(O&M) admitted to a Rehabilitation Center on 21.7.2015 for a period of 180 days. Reference is made to certificate (P-1) certifying the said period as an inmate. Therefore,while issuing notice of motion vide order dated 2.3.2016, it was ordered that in case petitioner surrenders before the trial court within 10 days,he shall be released on interim bail by the trial court to its satisfaction.

At the time of hearing today, an application bearing CRM No.9302/2016 has been moved seeking extension of time for surrender on the basis of a statement that the applicant/petitioner due to Epilepsy attack could not avail of the interim relief. After hearing the learned counsel for the petitioner, no case for extension of time is made out. No material has been placed on record to show that the applicant had actually suffered Epilepsy attack of such magnitude rendering him totally immobile. Dismissed.
