* * * ANIL KSHETARPAL, J. (ORAL) Petitioner prays for grant of regular bail in FIR No.227, dated 5.12.2017, registered under Section 21 of the Narcotic Drugs and Psychotropic Substances Act, 1985, at Police Station Doraha, District Ludhiana.
Learned counsel for the petitioner contends that the petitioner is only a Cab driver and recovery of 11⁄2 Kg. heroine was from the dashboard of the Car. Therefore, the petitioner cannot said to be in conscious possession thereof as there was another co-passenger also in the Car. CRM-M-26055-2019 (O&M) On the other hand, learned counsel for the State has submitted that the petitioner is owner of the car in question. The recovery from the petitioner is much more than the commercial quantity and no ground to grant concession of regular bail is made out. In view of above, this Court does not deem it appropriate that the petitioner should be released on regular bail. Thus, the petition is dismissed.
