State of Punjab .............Respondent CORAM: HON'BLE MR.JUSTICE JASWANT SINGH Present:- Mr.Rishu Mahajan,Advocate for the petitioner Jaswant Singh,J.(Oral) Prayer is for grant of anticipatory bail in case FIR No.03 dated 3.1.2014 under Sections 21/61/85 of the Narcotic Drugs and Psychotropic Substances Act,1985, PS Sadar,Amritsar. There was recovery of 500 grams of intoxicating tablets from the possession of the petitioner on 3.1.2014. He was granted interim bail on 30.5.2014 and for his absence on 26.3.2015 his bail bonds were cancelled and non-bailable warrants issued for securing his appearance on 27.4.2015.

Learned counsel submits that petitioner had met with an accident on 25.3.2015 and thereafter could not appear on 26.3.2015. It is submitted that petitioner was advised bed rest on account of problem in the spine. He is stated to have remained under treatment at Guru Nanak Dev Hospital,Govt.Medical College, Amritsar. CRM-M 7588/2016 After hearing counsel for the petitioner no case for grant of anticipatory bail is made out. It is conceded position that petitioner was never admitted in the Hospital and at best had been appearing as Outdoor patient on different dates. It is also conceded that no application seeking exemption from personal appearance on 26.3.2015 was made and also no application moved before 26.4.2015 seeking recall of the orders on account of alleged injury. In fact, he applied for grant of anticipatory bail on 2.1.2016 and admittedly proclamation proceedings had already started.

In the light of petitioner having taken the court proceedings so lightly for nine months, no case for grant of anticipatory bail is made out.

Dismissed.
