The name of the petitioner is mentioned in the secret information that he along with Roshan Singh was carrying 300 kgs of poppy husk. The petitioner has been involved in the case on the basis of statement of Roshan Singh, disclosing that the petitioner was the person, who escaped from the spot on the day of the recovery of the contraband. So far as the petitioner is concerned, he was arrested after a period of two years of the recovery. Whether the petitioner will be deemed to be in possession of the poppy husk, recovered from the co-accused, will be a debatable issue during trial.

The petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail bonds/ surety bonds to the satisfaction of the trial court.
