After hearing the learned counsel and perusing the Annexures, especially para 2 of the copy of the suit (P-2), it is apparent that the petitioner accused sold land measuring 8 kanals vide sale deed dated 30.5.2012 to Hardeep Kaur wife of Nachhattar Singh during the pendency of a civil suit filed by complainant Hardam Singh for specific performance in contempt of order dated 13.8.2009 restraining him from alienating the suit property operative till the decision of the suit on 16.4.2013. It is also a matter of fact that it was never brought the notice of the trial court.
