Present petition under Section 438 Cr.P.C. for seeking pre-arrest bail to the petitioner(s) in case FIR No. 183 dated 17.7.2015, registered under Section(s) 22 of the Narcotic Drugs & Psychotropic Substances Act, 1985 at Police Station Phillaur, District Jalandhar. Learned counsel for the petitioner contended that allegations against the petitioner are recovery of 27 grams of heroin and he was admitted to bail in this case, but on the last date of hearing i.e. 27.9.2017, he could not put in appearance in the Court as he is suffering from serious ailment of HIV Aids. Learned counsel further contended that petitioner is ready to surrender before the learned Court below. Having considered the above-mentioned facts, present petition stands disposed of with the direction that petitioner shall surrender before the learned Court below and move an application for his release on bail on his furnishing fresh bail and surety bonds.
