The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.109 dated 3.9.2018 registered for the offences under Sections 457 and 380 IPC at Police Station Bareta, District Mansa.

I have heard learned counsel for the petitioner and have gone through the record.

From the record, I find that the FIR in the present case has been got registered by complainant Varinder Kumar alleging that at night time mobile phones of various companies etc. had been stolen from his shop. Two persons were seen in the CCTV camera. The present petitioner is nominated in this case. The stolen articles are still to be recovered, therefore, the petitioner is required for custodial interrogation. Cr. Misc. No.M-49887 of 2018 [2] Keeping in view the facts and circumstances of the case; in view of the nature and gravity of the offences and in view of the fact that the petitioner is required for custodial interrogation, I do not find it a fit case where the petitioner is entitled for the grant of anticipatory bail. Therefore, finding no merit in this petition, the same is dismissed.
