(ORAL) This Court was pleased to pass the following order on 10.01.2018 :- "By way of this petition filed under Section 438 of the Code of Criminal Procedure, prayer for anticipatory in FIR No. 93 dated 23.7.2017 under the newly added Sections 7 and 8 of the Protection of Children from Sexual Offences Act, 2012 and Section 120-B of the IPC registered at Police Station Goindwal Sahib, District Tarn Taran has been made.

Learned counsel for the petitioner contends that the daughter of the complainant had, in fact, solemnized marriage with petitioner No.1 and had appeared in proceedings in Crl. Misc. M 28822 of 2017 and made a statement in Court that she is residing happily with her husband in her matrimonial home.

CRM-M-499-2018 -2doing so, the petitioner be released on interim bail subject to his furnishing personal bonds and surety to the satisfaction of Arresting/Investigating Officer. However, the petitioner shall continue to join the investigation as and when called upon to do so and shall abide by the conditions as provided under Section 438

(2) Cr.P.C."

Learned counsel for the petitioners submits that the petitioner have joined the investigation.

Learned counsel for the respondent-State, on instructions from HC Jaspal Singh, confirms the factum of joining investigation by the petitioners.

Since the petitioners have joined the investigation, the petition is allowed and interim order dated 10.01.2018 is hereby made absolute subject to the condition that the petitioners will not tamper with evidence or hamper the investigation; will not leave India without permission of the Court and will comply with the conditions contained in Section 438(2) Cr.P.C.
