State of Punjab and others ........ Respondents
CORAM:
HON'BLE MR. JUSTICE ANOOP CHITKARA Present:- Mr. Jatinder Singh, Advocate for the petitioner. Mr. Harsimar Singh Sitta, AAG, Punjab.
**** ANOOP CHITKARA, J. (ORAL) Learned State counsel on instructions submits that out of 37 acres of land, the crops are standing in approximately 10 acres. Since the crops are perishable, the market value would depend upon the demand and supply. Given above, the petitioner is permitted to harvest the said crops with a condition that he shall obtain the sale proceeds by way of a demand draft drawn in favour of the receiver. It is clarified that in case the petitioner tries to misappropriate the sale proceeds by taking it under the table or any cash transaction, it will be treated as the contempt of Court.
This petition is disposed of with liberty to reserve to file a fresh petition challenging the remaining prayer clauses after annexing the receipt of the sale proceeds along with the photocopy of the demand draft. The petitioner shall also be liberty to challenge impugned order. It is also clarified that the disposal of the present petition shall not come in the way to take other legal remedies.
