***** Rajan Gupta, J. (Oral) This petition has been filed under Section 439 Cr.P.C. seeking regular bail to the petitioner in a case FIR No.2 dated 25.07.2017 under Section 15/61/85 of NDPS Act, registered at Police Station STF, Phase-4, SAS Nagar (Mohali).
According to the prosecution, three vehicles were intercepted on 25.07.2017. FIR, in question, was registered. Recovery of 150 Kgs of poppy husk was effected from the vehicles. Petitioner was in I 20 car and alleged to be carrying two bags of poppy husk weighing 30 Kg. each. It has been urged before the court that the quantity of poppy husk recovered from the petitioner, is marginally higher than the commercial quantity. This court does not wish to express any opinion on the merits of the case. However, keeping in view the contention raised and period of incarceration of the petitioner, it feels that he is entitled to concession of bail pending trial. Ordered accordingly. Petitioner is directed to be enlarged on bail to the satisfaction of Chief Judicial Magistrate/Duty Magistrate, SAS Nagar (Mohali).
