Naresh Kumar Sanghi, J.(Oral) Prayer in this petition, filed under Section 438, Cr.P.C., is for grant of anticipatory bail to the petitioners, Radha Rani (mother-in-law) and Subhash Chander (father-in-law) of informant, Kiran Bala, who have been booked for having committed the offences punishable under Sections 406, 498-A, and 506, IPC, in a case arising out of FIR No.50, dated 16.02.2015, registered at Police Station, Safidon, District Jind. Learned counsel contends that the son of the petitioners, who is husband of the informant, has already been arrested and the alleged dowry articles were recovered from him; in compliance of the interim directions issued by this Court vide order dated 19.03.2015, the petitioners did join the SEEMA RANI 2015.09.04 10:53 I attest the accuracy and authencity of the document
[2] investigation and co-operated with the Investigating Agency; and that just to frustrate the fate of the present petition, the Investigating Agency is time and again making the wrong averment that the petitioners have not joined the investigation. He also submits that even after grant of concession of anticipatory bail, the petitioners would continue to co-operate with the Investigating Agency.
Learned counsel for the State, on instructions from HC Mahipal, Police Station, Safidon, District Jind, submits that though the petitioners have joined the investigation yet they have failed to co-operate with the Investigating Agency. However, he fairly concedes that the son of the petitioner was arrested and granted bail.
In view of the totality of the facts and circumstances of the case, the present petition is allowed. Interim directions dated 19.03.2015 issued by this Court are made absolute. The petitioners shall continue to join the investigation as and when required to do so and abide by all the terms and conditions as laid down under Section 438(2), Cr.P.C.
