On the instructions of ASI Lakhbir Singh, it has been informed that the petitioner has joined the investigation. It has also been admitted that the petitioner, after arrest, has been granted the concession of regular bail but on account of offence u/s 326 IPC having been added later on on account of grievous injury having been attributed to the petitioner on the back side of left hand of the complainant, the petitioner apprehending arrest has filed the present petition for pre-arrest bail. Pursuant to the interim order passed by this court, the petitioner has already joined the investigation in the added offence u/s 326 IPC. It does not appear to be a case where the petitioner is required to be re-arrested and sent in custody.
Accordingly, the petition is allowed and it is ordered that in case of arrest of the petitioner in the added offence, he will be released on bail to the satisfaction of the arresting officer subject to the condition that he will join the investigation as and when required by the police and will not tamper with evidence or hamper the investigation.
