Learned State Counsel, on instructions, meted to him, by the SI Rattan Singh, Investigating Officer, submits that in respect of FIR No. 121 of 29.03.2021, the Investigating Officer concerned, has proposed to file a closer report before the learned Magistrate concerned, and, that it is awaiting an affirmative recommendation from the authorities concerned. 2.
In the face of above, the extant petition, at this stage, becomes infructuous, and, is disposed of as such.

However, in case the closer report is not recommended, to be instituted before the learned Magistrate concerned, or, if it is not accepted by the learned Magistrate concerned, thereupon, the Investigating Officer concerned may not arrest the bail applicant without serving him with a seven days prior notice.
