The petitioner has approached this Court seeking grant of regular bail in respect of a case registered against him vide FIR No.27 dated 18.02.2021 at Police Station "C" Division, Amritsar, District Amritsar, under Sections 379-B/34 of IPC, wherein it is alleged that the petitioner while brandishing a 'datar' had snatched a mobile phone from the complainant.

Learned counsel for the petitioner submits that he has falsely been implicated in the present case and that in any case he has been behind bars for a substantial period and is not even involved in any other case.

On the other hand, learned State counsel has opposed the petition while submitting that there are serious allegations against the accused. It has, however, been informed that the petitioner has been behind VANDANA YADAV 2021.12.10 16:49 I attest to the accuracy of this order

CRM-M-29413-2021 bars since the last about 9 months and 17 days and that he is not involved in any other case.

I have considered rival submissions addressed before this Court. 5.

Without commenting anything as regards the merits of the case, but while noticing that the petitioner has a clean record and has been behind bars for a substantial period of more than 9 months, further detention of the petitioner will not serve any useful purpose. The petition, as such, is accepted and the petitioner is ordered to be released on regular bail on his furnishing bail bonds/surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned.
