Petitioners are seeking a writ of mandamus directing the respondent no.2 to decide the revision petition dated 28.3.2019 (Annexure P-5) and the application dated 23.4.2019 (P-6) seeking stay of operation of the impugned order, in the time bound manner. Kuldip Singh and others filed a suit under Section 7(2) of the Punjab Village Common Lands (Regulation)Act,1961 against Jasbir Singh, Rattan Singh,predecessors-in-interest of the petitioners and five others alleging encroachment upon Gair Mumkin Johar by them. After hearing both sides, the learned ACIG,Karnal ordered the removal of the illegal possession of the respondents (petitioners herein) in the said suit vide order dated 31.5.2017(P-1). Aggrieved against the same Jasbir Singh and Rattan Singh filed appeal before Collector-cum-Deputy Commissioner,Karnal. CWP 13938/2019 dismissed by Collector,Karnal vide order dated 22.11.2017(P-2). The revision petition filed against said order was also dismissed vide order dated 7.12.2018(P-3). It is thereafter that Jasbir Singh and others filed ROR No.366/2019 before Financial Commissioner,Haryana, Chandigarh, the disposal of which alongwith stay application is sought in a time bound manner. After arguing for sometime and having failed to convince the Court, regarding maintainability of a second revision, learned counsel seeks permission to withdraw the petition. Dismissed as withdrawn.
