(Oral) By way of present petition under Section 439 Cr.P.C., the petitioner has prayed for grant of regular bail in case FIR No.45, dated 18.01.2020, under Sections 302, 506, 34 IPC (added lateron) Section 25 of the Arms Act, 1959 (added later on), whereas, offence under Sections 148 and 149 IPC (were deleted), registered at Police Station HTM Hisar, District Hisar.
Learned counsel for the petitioner submits that the petitioner is behind the bars for the last almost 3 years and the complainant stand examined, who has not even supported the prosecution story. He further submits that at the time of occurrence, petitioner, happened to be a young boy of 19 years of age and there is no other criminal case registered against him.
Learned counsel for the petitioner also submits that in the present case, there was only one single blow on the person of the deceased SONIKA 2023.01.11 17:49 I attest to the accuracy and authenticity of this document
CRM-M-27000-2022 --2-- and the co-accused of the petitioner, namely, Sarwan and Akshey have already been granted the concession of regular bail by this Court passed in CRM-M-31331-2020 and CRM-M-39052-2020, decided on 17.09.2021, as such, the petitioner also deserves the concession of regular bail considering the aforesaid facts.
On the other hand, learned State counsel vehemently opposes the prayer made in the petition while submitting that the deceased happened to be a young boy of 20 years and keeping in view the seriousness of offence, the petitioner does not deserve the concession of bail. I have heard learned counsel for the parties and gone through the paper book.
Consdiering the aforesaid submissions and without commenting upon the merits of the case, lest it may prejudice the interest of any of the parties, in view of the long incarceration of the petitioner as well as the fact that the complainant stand examined and the present happens to be a case of single blow and also the fact that the co-accused have already been granted the concession of bail by this Court passed in CRM-M-31331-2020 and CRM-M-39052-2020, decided on 17.09.2021, the present petition is allowed and petitioner, namely, Raman @ Raman Saharan Kajla is ordered to be released on bail, subject to his furnishing bail bonds and surety bonds to the satisfaction of the concerned trial court/Duty Magistrate. 11.01.2023 (HARKESH MANUJA) sonika JUDGE Whether speaking/reasoned:
