(ORAL) Petitioner seeks quashing of the order dated 21.4.2012 (Annexure P-7), wrongly mentioned as 21.1.2012 at page 32 of the paper book, whereby the petitioner was declared proclaimed offender in FIR No. 126 dated 7.7.2011 under Sections 420/498A/406/506/120-B IPC, registered at Police Station Samrala, Police District Khanna, District Ludhiana.
Learned counsel for the petitioner, at the very outset, fairly states that petitioner is ready and willing to surrender before the learned trial court within a period of one week from today. Learned counsel for the petitioner restricts his prayer to the extent that learned trial court may be directed to consider the application of the petitioner sympathetically and decide the same at an early date. CRM-M-8954 of 2015 Having heard the learned counsel for the petitioner and without expressing any opinion on the merits of the case, lest it should prejudice the rights of either of the parties, present writ petition is disposed of with a direction to the learned trial court that if the petitioner surrenders within a period of one week from today, an appropriate application to be moved on his behalf shall be considered keeping in view the peculiar facts and circumstances of the case and the said application shall be decided at an early date, by passing an appropriate order thereon, in accordance with law. With the abovesaid observations made and directions issued, present petition stands disposed of.
