The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.188 dated 29.10.2015 registered for the offence under Section 13 of the Punjab Gambling Act, 1867 (hereinafter referred to as `the Gambling Act') and (Section 3 of the Gambling Act, which was added later on) at Police Station 'E' Division, District Amritsar City.

Notice of motion has been issued in this case. Mr. Pawan Sharda, learned Senior Deputy Advocate General, Punjab has put in appearance on behalf of the respondent-State and contested this petition.

I have heard learned counsel for the petitioner and learned State counsel and have gone through the record.

In the present case, the FIR was registered for the offence under HARPAL SINGH PARMAR 2018.12.06 15:57 I attest to the accuracy and authenticity of this document Chandigarh

Cr. Misc. No.M-50023 of 2018 [2] Section 13 of the Gambling Act. The present petitioner is stated to have been declared as proclaimed offender. In compliance with the interim order passed on 16.11.2018, the petitioner has already surrendered before the trial Court and has been released on interim bail by the trial Court. The petitioner has only to face the trial. No useful purpose will be served by sending the petitioner to custody.

Keeping in view the facts and circumstances of the present case; I find merit in this petition and the same is allowed. The interim order dated 16.11.2018 passed by this Court granting interim bail to the petitioner is made absolute.
