The petitioner is alleged to have forged documents and not deposited the tax on behalf of the school. Besides this, the petitioner allegedly deposited Rs.15750/- as permit fee of the school buses instead of Rs.51750/-.

In view of the above, it will be a debatable issue whether the petitioner could be said to have violated the rules of Law of Taxation. Learned State counsel informs that no one, on behalf of the prosecution agency, has approached her to contest the petition. The petition is allowed and it is ordered that in case of arrest of the petitioner, he will be released on bail to the satisfaction of the arresting officer subject to the condition that the petitioner will join the investigation as and when required by the police and will not tamper with evidence or hamper the investigation.
