PANKAJ JAIN, J. (ORAL) Apprehending his arrest in FIR No.0028, dated 12th May, 2022, registered under Section 420 of the Indian Penal Code and Section 13 of Punjab Travel Professionals (Regulations) Act, 2014, at Police Station Kahnuwan, District Gurdaspur, petitioner seeks pre-arrest bail. 2.

On asking of the Court, Mr. Sukhbeer Singh, Asstt. Advocate General, Punjab appears and accepts notice on behalf of the respondent/ State.

As per the allegations levelled in the FIR, the petitioner is running a business of sending people abroad for employment. He cheated the victims namely Vijay Masih son of Bhajan Masih and Bikram Masih son of Baldev Masih of Rs.3 lakh on the false pretext of sending them abroad and getting them job of packing in order to earn Rs.35,000/- per DEEPAK KUMAR 2022.06.10 18:37 I attest to the accuracy and integrity of this document
CRM-M-26233-2022 -2month. On 10th August, 2019 the petitioner took both the victims from Amritsar airport to Mumbai and thereafter on 11th August, 2019 from Mumbai airport to Jordan, and took Rs.1 lakh each from both of them. The victims did not get any employment there. After that Vijay Masih and Bikram Masih returned to India on 6th of September, 2019 at their own expenses. It has been further mentioned that the petitioner promised to repay the said amount to the victims however the same has not been paid to them till date.

Ld. Counsel for the petitioner submits that the petitioner has been falsely implicated and in fact so far as the visit of the victims to Jordan is concerned, that is not disputed.

Finding it to be a case where the poor and innocent people have been lured by showing green pastures and have been robed off their hard earned money, this Court does not find it to be a fit case for grant of pre-arrest bail to the petitioner.
