Challenge in the present writ petition is to the order dated 17.02.2026 (Annexure P-4) passed by respondent No.2. 2.

One Suresh Jindal, who is stated to be the owner of the property in dispute, had preferred a writ petition being CWP-32291-2025 which was disposed off vide order dated 03.11.2025 observing as under : '3. Accordingly, at this stage, without commenting on the merits of the case, the writ petition is disposed of with a direction to respondent No.2 to take a decision on the representation dated 02.07.2025 (Annexure P-5), made on behalf of the petitioner, by passing a speaking order and after affording opportunity of hearing to all affected parties, preferably within two months from the date of receipt of a copy of this order.

4. Needless to add that the decision so taken be communicated to the petitioner and if the decision is not AMAN JAIN 2026.04.24 09:09 I attest to the accuracy and integrity of this order/judgment

CWP-12078-2026 (O&M) -2to the satisfaction of the petitioner, he would be at liberty to challenge the same, in accordance with law'. Pursuant to the said order, respondent No.2 passed the impugned order dated 17.02.2026. The grievance of the petitioner is that despite the order passed by this Court dated 03.11.2025 specifically directing that an opportunity of hearing be given to all the affected parties, the petitioner, who is the tenant over the property in dispute, has not been given an opportunity of hearing. 3.

Mr. Saurabh Mago, DAG Haryana accepts notice on behalf of the respondents. Learned counsel for the respondents states that respondent No.2-Director Panchayat, Haryana Bhawan be directed to decide the matter afresh after affording an opportunity of hearing to all concerned. 5.

In view of the above, the present writ petition is allowed and the order dated 17.02.2026 (Annexure P-4) is set aside. The respondent No.2Director Panchayat, Haryana Bhawan is directed to decide the matter afresh after affording an opportunity of hearing to all concerned/affected parties in accordance with law.
