(Proceedings through video conferencing) **** RAJ MOHAN SINGH, J. (Oral) Learned counsel for the petitioner contends that the petitioner is a work contractor. Municipal Corporation, Gurgaon had allocated the work assignment to the petitioner on 08.01.2016 in respect of providing water supply to village Dundahera. Petitioner had completed the work assignment on 19.11.2016 and submitted his completion report. Petitioner was not paid the amount of third and final bill for the work done despite numerous requests. Ultimately, the petitioner had to file CWP No.4867 of 2017 on 07.03.2017, in which High Court was PRINCE SAINI 2021.12.20 17:23 I attest to the accuracy and integrity of this document

CWP No.20474 of 2021(O&M) pleased to direct the respondents to consider the claim of the petitioner within a specified period of three months. Owing to inaction on behalf of the respondents, the petitioner also filed COCP No.1816 of 2017 and it was only thereafter, an amount of Rs.69,14,456/- towards final bill and an amount of Rs.9,96,835/- towards security were released in favour of the petitioner, but without paying any interest towards delayed payment. There was an inordinate delay of three years in releasing the due amount to the petitioner. Petitioner has preferred this writ petition only to the extent of claiming interest for the delayed payment for a period of about 3 years.

Notice of motion.

In view of nature of controversy involved in the present case, this petition is directed to be treated as representation before respondent No.4. Respondent No.4 is directed to pass appropriate order in the aforesaid context within a period of one month from the date of receipt of certified copy of this order. Disposed of.
