(ORAL) Petitioner seeks concession of pre-arrest bail in a case registered at the instance of Om Parkash alleging that the petitioner has extorted a sum of Rs.18 lacs from the complainant on the pretext of obtaining a job for him in Rajasthan Civil Services. The petitioner had not returned the said amount.

After hearing the counsel for the petitioner as well as the State counsel and the counsel for the complainant, it transpires that the resources of the complainant to pay a sum of Rs.18 lacs appears to be debatable on the basis of the investigation conducted. The petitioner has joined investigation. The petitioner has also filed two complaints under Section 138 of the Negotiable

CRM-M-9069-2015 (O&M) Instruments Act, against the complainant.

State counsel, on the instructions of SI Charan Singh informs that the petitioner has joined investigation. It does not appear to be a case of custodial interrogation. The petition is allowed. It is ordered that in case of arrest of the petitioner, he shall be released on bail to the satisfaction of the arresting officer subject to the conditions that the petitioner will join investigation as and when required and will not tamper with the evidence or hamper investigation, in any manner.
