The instant writ petition has been filed under Articles 226/227 of the Constitution of India, claiming the following reliefs:- i) summon the entire records of the case for its kind perusal;

ii) issuance of an appropriate writ, order or direction especially in the nature of Certiorari for quashing of Letter and Seniority List dated 06.04.2026 (Αnnexure P-7) qua the Respondent 6/Rajinder Singh as the same has been issued without deciding the objections submitted by the petitioner;

iii) Issue an appropriate writ, order or direction, particularly in the nature of Mandamus, directing the respondents to forthwith consider and decide the objections submitted by the petitioner, which have admittedly been

received and acknowledged by the respondent department through various communications [dated 12.11.2025 (P-3), 04.12.2025 (P-4) and 06.03.2026 (P-6)], but no action has been taken nor any reply has been furnished till date; iv) Further issuance of directions to the Respondent No.5/Municipal Council, Rampura Phul to take necessary and expeditious action on the letters and communications received from the higher authorities regarding the objections submitted by the petitioner, in accordance with law;

v) Issue further appropriate directions restraining the respondents from considering or promoting Respondent No. 6 to any higher post till the pendency of this petition. vi) It is further prayed that this Hon'ble Court may issue any other appropriate writ, order or direction as this Hon'ble Court may deem fit in the facts and circumstances of the case.

Learned counsel for the petitioner submits that he would be satisfied if the legal notice dated 24.02.2026 (Annexure P-5) of the petitioner is decided by respondent No.5 by passing a speaking order in a time bound manner.

Mr. Sangam Garg, Advocate has put in appearance on behalf of respondent No.5 and file Memo of Appearance, which is taken on record. The Registry is directed to tag the same at appropriate place. 4.

Learned State counsel, appearing on advance notice, as well as learned counsel for respondent No.5 submits that they have no objection, in case a direction is issued to the respondent No.5 for time-

bound consideration and decision of the legal notice dated 24.02.2026 (Annexure P-5) of the petitioner by passing a speaking order. 5.

Therefore, in view of the limited prayer made by learned counsel for the petitioner, respondent No.5 is directed to consider the legal notice dated 24.02.2026 (Annexure P-5) of the petitioner and pass a speaking order, after affording an opportunity of hearing to the petitioner, within a period of 03 months from the date of receiving a certified copy of this order. Further, the decision taken thereof shall be conveyed to the petitioner. Needless to say, if the petitioner is found entitled to the relief sought, the same shall be granted forthwith by respondent No.5.
