Rajan Gupta, J (Oral) This is a petition under Section 482 Cr.P.C seeking quashing of FIR No.110 dated 2.5.2013 registered under Sections 406, 498-A, 494 IPC at Police Station, Tanda, District Hoshiarpur on the basis of compromise.
In view of order dated 20.3.2015 passed by this court, report has been received from the trial court. Operative part thereof reads as under:- "In the above said order, the Hon'ble Punjab and Haryana High Court was directed the parties to appear before this court on 28.4.2015. In view of above order Darshan Singh s/o Charan Singh r/o village Awan Bhikhi Shah, Tehsil Bholath, Distt. Kapurthala appeared as power of attorney of Joginder Singh s/o Charan Singh in the present FIR No.110 dated 2.5.2013 and got recorded his statement. It is pertinent to mention here that Joginder Singh s/o
CRM-M-9097 of 2015 2 Charan Singh has already been declared proclaimed offender on 11.3.2015 and he has not come present to record his statement. The report is hereby submitted for kind consideration and further necessary action please."
Learned State counsel submits that Joginder Singh was declared proclaimed offender on 11.3.2015. Learned counsel representing respondent No.2 denies the factum of compromise. In view of above, there is no merit in this petition. Dismissed.
