**** HARSIMRAN SINGH SETHI , J. (ORAL) In the present writ petition, the grievance of the petitioner is that though he retired on 31.03.2017, but due to the pendency of a charge-sheet which was issued on 04.07.2016, all the pensionary benefits for which the petitioner becomes entitled on his retirement, has not been released.

Counsel for the petitioner argues that non-finalization of the enquiry by the respondents is causing prejudice to the petitioner as he has not been released the pensionary benefits without which he is not able to survive properly after his retirement.

Counsel for the petitioner prays that appropriate directions be issued to the respondents for deciding the above-said charge-sheet in a time bound manner.

On the asking of the Court, Ms. Safia Gupta, Assistant Advocate General, Haryana, accepts notice on behalf of the respondentsState. After going through the contents of the writ petition, counsel for the respondents-State states that the respondents-State have no objection in case the prayer made by the counsel for the petitioner with regard to completing the proceedings of the above-said charge-sheet within a time bound manner is accepted.

Keeping in view the above, present writ petition is disposed of with the direction to the respondents to complete the proceedings in respect of the charge-sheet dated 04.07.2016 within a period of three months from the date of receipt of certified copy of this order. It is directed that the petitioner shall cooperate with the respondent authorities to comply with this order for deciding the charge-sheet in a time bound manner. In case the petitioner does not cooperate, the respondents shall be liberty to approach this Court. It is, however, made clear that this Court express no opinion on the merits of the case or the entitlement of the petitioner in respect of the claim of pensionary benefits.
