No.2024:PHHC:026072 CRM-M-25320-2023 (O&M) -2- <Learned counsel for the petitioner inter alia submits that in the present case the petitioner was never apprehended at the spot and has been implicated merely for the reasons that he is the owner of the vehicle in question, besides it he also points out that there is no other case of NDPS pending against the petitioner and alleged recovery in the present case is of non-commercial quantity.

Notice of motion for 13.09.2023.

In the meanwhile, petitioner will join investigation before the Investigating Officer as and when called. In the event of his arrest, the Arresting Officer would admit him to interim bail, till the next date of hearing, on his furnishing adequate bail and surety bonds to his satisfaction. The petitioner is also directed to abide by all the conditions as envisaged under Section 438(2) of Code of Criminal Procedure, 1973."
