The petitioner has filed the instant petition under Articles 226/227 of the Constitution of India, seeking issuance of a writ of certiorari for quashing Point No.6, Serial No.4 of the Advertisement No.8 of 2023 (Annexure P-1) to the extent it prescribes 6 month diploma from recognized Aero Modeling Institute as the same is beyond Rules, known as Punjab Education Department (State Service Class IIINCC Cadre) Rules, 1964 (Annexure P-12) and speaking order dated 12.10.2025 (Annexure P-9), vide which the claim of the petitioner for selection of Aero Modeling Instructor has been rejected. Further, seeking issuance of a writ of mandamus directing the respondents to appoint the petitioner as Aero Modeling Instructor being eligible and had applied in pursuant to Advertisement No.8 of 2023 and further has qualified written test and after that verification of documents was also got done but later on he was declared ineligible in the merit list-cumresult. After arguing the case for sometime and in view of the order dated 04.11.2025 (Annexure P-10) passed by this Court, in the earlier petition filed by the petitioner bearing No.CWP-32683-2025 (Gaurav Sharma Vs. State of Punjab and others) claiming the same relief as has been claimed in the instant petition, learned counsel for the petitioner wishes to withdraw the instant petition with liberty to avail other legal remedies in accordance with law.
