The petitioner through instant petition under Article 226/227 of the Constitution of India is seeking quashing of order dated 26.11.2025 whereby respondents refused to grant Police Clearance Certificate (PCC). He is further seeking direction to respondents to issue him PCC. 2.

The petitioner is residing in Canada since 22.09.2022. He was implicated in FIR No. 127 dated 22.09.2022 under Sections 279,337 and 427 of IPC. He claims that police filed cancellation report on 15.08.2024 before the trial Court which on account of objection raised by complainant ordered further investigation. He has been falsely implicated in the aforementioned FIR and at present requires PCC for extension of his stay in Canada.

On being confronted with the fact that police filed cancellation report though was not accepted by trial Court, learned State counsel submits that the competent authority would reconsider petitioner's claim in the light of judgment of this Court in "Mohan Lal @ Mohna Vs. Union of India", 2023 SCC OnLine P&H 1391. The needful would be done within two weeks from today. 4.

Learned counsel for the petitioner agrees to the aforesaid arrangement.

In the wake of statement of both sides, the instant petition stands disposed of 6.
