***** JASJIT SINGH BEDI, J. (Oral) The prayer in the present petition under Section 439 Cr.P.C. is for the grant of regular bail to the petitioner in a case FIR No.20 dated 04.05.2022 under Section 498-A IPC registered with Police Station Purana Shalla, District Gurdaspur.

The present FIR came to be registered at the instance of Sumandeep Kaur, who stated that her marriage was solemnized on 08.05.2021 with Hardeep Singh (petitioner herein). Huge expenses were incurred on the marriage but the present petitioner demanded a car from her parents when she was expecting a child. Her in-laws family also harassed her from time to time and gave her a medicine to terminate her pregnancy against her wish. Thereafter, the petitioner-husband left her at her parental home and her in-laws were again demanding a car failing which she would not be brought back to the matrimonial home.

was not good towards the petitioner and his family members and she used to pick up quarrels on petty matters and she did not do any house hold work and remained confined to her room. She also left the matrimonial home from time to time and to go her parental home and suddenly, on one fine day, without informing the petitioner while he was away for the work, the complainant left the matrimonial home and went to her parental home. The petitioner and his family members went to the parental home of his wifeSumandeep Kaur but were abused and given beatings. He, therefore, contends that it is the complainant-wife who refused to come back to the matrimonial home despite making multiple attempts to cohabit with her.

He further contends that the allegations of demand of dowry are completely non-specific and even otherwise, the petitioner is in judicial custody since 25.05.2022 and his further incarceration is not required. The learned counsel for the State, on the other hand, contends that the petitioner does not deserve the concession of regular bail in view of his conduct and behaviour with the complainant-wife. I have heard the learned counsel for both the parties. Admittedly, the petitioner is in judicial custody since 25.05.2022. The investigation shall take its own course and as such the further incarceration of the petitioner is not required.

Thus, without commenting upon the merits of the case, the present petition is allowed and the petitioner, namely, Hardeep Singh, is ordered to be released on bail to the satisfaction of the Trial Court/Duty Magistrate concerned.
