CHANDIGARH.

Civil Writ Petition No.15482 of 2021 (O&M) Date of Decision: August 13, 2021 Simpi Goel ..........Petitioner.

VERSUS

Mewat Model School Society and others ........Respondents.

CORAM:- HON'BLE MR. JUSTICE G. S. SANDHAWALIA

Present:

Mr. Mazlish Khan, Advocate for the petitioner.

(The proceedings are being conducted through video conferencing, as per instructions) ******* G.S. SANDHAWALIA, J.(Oral) By filing the present civil writ petition under Articles 226/227 of the Constitution of India, petitioner seeks the benefit that the leaves availed by her on 11th November, 2014 and 24th April 2015 have been treated as 'leave without pay', whereas she has availed those leaves from her casual leave, which were available in her casual leave account. Thus, she seeks rectification of the service book and decision on the legal notice dated 26.03.2021 (Annexure P-4).

Perusal of the legal notice (Annexure P-4) does not show as to when the cause of action accrued to the petitioner. In the considered opinion of this Court after a period of 7 years, petitioner cannot be allowed to rectify these mistakes by seeking directions that the legal notice (Annexure P-4) be decided.

115 CWP-15482-2021 -2It is open to the petitioner to take recourse to the alternate jurisdiction, if any and this Court does not feel that it is a fit case to exercise its writ jurisdiction. Accordingly, this petition is dismissed in limine. ( G. S. SANDHAWALIA ) August 13, 2021 JUDGE Sachin M.
