Learned counsel for the petitioners argues that the petitioners are entitled for the grant of benefit of statutory pay-scale as admissible to them under the rules governing in the service, whereas, the said benefit has not been extended to the petitioners by the respondents, which act on the part of the respondents is arbitrary and illegal.

Learned counsel for the petitioners further submits that the issue raised in the present petition has already been answered by this Court while passing order in CWP No. 15896 of 2023 titled as Saurabh Sharma and others versus State of Punjab and others' alongwith other connected cases, decided on 13.09.2024, which judgment has already been upheld upto the Hon'ble Supreme Court of India, hence, the petitioners are also entitled for RIYA 2025.04.29 17:47 I attest to the accuracy and integrity of this document

CWP-11499-2025 (O&M) -2the same benefits as being granted to the petitioners in Saurabh Sharma's case (Supra).

Notice of motion.

On the asking of the Court, Mr. TPS Chawla, Sr. DAG, Punjab, who is present in Court, accepts notice on behalf of the respondent-State 3 and submits that the claim of the petitioners regarding the grant of benefit of Statutory pay-scale as being sought in the present petition will be considered and decided by the authorities concerned by keeping in mind the judgment passed in Saurabh Sharma's case (Supra) within a period of eight weeks from the receipt of certified copy of this order by passing an appropriate speaking order.

Learned counsel for the respondents further submits that in case the claim of the petitioners are found feasible to be accepted, an appropriate order will be passed and in case the same is not found feasible to be accepted, detailed reasons for rejecting the claim of the petitioners will be mentioned in the speaking order and the same will also be conveyed to the petitioners as well.

Learned counsel for the petitioners submits that keeping in view the statement of learned State counsel, the present petition may kindly be disposed of having been not pressed any further. 7.

Ordered accordingly.

Pending civil miscellaneous application, if any, stands disposed of.
