The present revision petition has been filed under Article 227 of the Constitution of India for setting aside the order dated 07.12.2023 whereby visitation rights have been given to the petitioner-father to meet his minor child for 03 hours once a month in the precincts of Kali Mata Mandir, Sangrur in the presence of the respondent-mother of the child or one of her family members.

Learned counsel for the petitioner-father would contend that the petitioner-father would not be able to interact in a conducive manner with the child in the presence of other family members and also that precincts of a Mandir would not be an ideal place for an interaction between the petitionerfather and the child. Learned counsel for the petitioner-father would further contend that the visitation rights have been restricted to once a month and prays that visitation rights be given at least twice a month. Learned counsel appearing on behalf of the respondent-mother would contend that he has instructions to state that there is a multiplex by the name of Punia Towers in Sangrur where the respondent-mother can take the minor child and the petitioner-father can spend time with the child. Learned counsel for the respondent-mother has further contended that he has instructions to state that the respondent-mother would have no objection to visitation rights twice a month.

In view of the submissions made by learned counsel for the parties, the present revision petition is disposed off with the direction that petitioner-father shall have visitation rights on every alternate Sunday. The respondent-mother shall take the minor child to the multiplex Punia Towers, Sangrur at 11.00 am on every alternate Sunday and hand over the custody to the petitioner-father for a period of 03 hours. The respondent-mother may remain in the multiplex complex, however, she would not interrupt the meeting between the father and the child. It is made clear that the petitionerfather shall go alone to meet the child and not alongwith other family members. The petitioner-father shall also not take the minor child out of the multiplex complex premises.
