Learned counsel for the petitioner submits that before passing the impugned order dated 01.06.2022 (Annexure P-6), no show cause notice was issued to the petitioner in terms of letters dated 15.11.2018 (Annexure P-4) issued by the Additional State Project Director and 15.03.2019 (Annexure P-5) issued by the O.S.D. to DGSE, as such, order dated 01.06.2022 (Annexure P-6) is liable to be set aside.

Learned counsel for respondents No.2 and 3 submits that perusal of the impugned order dated 01.06.2022 (Annexure P-6) would show that in fact, no final order has been passed in respect of termination of services of the petitioner. He submits that order dated 01.06.2022 (Annexure P-6) is only a recommendation for termination of services of the petitioner. He further submits that before taking final decision in respect of termination of services of the petitioner, letters dated 15.11.2018 (Annexure P-4) and 15.03.2019 (Annexure P-5) shall be taken into consideration.

A perusal of the order dated 01.06.2022 (Annexure P-6) would show that only a recommendation has been made for terminating services of the petitioner and no final order has been passed. 6.

In light of the statement given by learned counsel for respondents No.3 and 4 that before taking final decision in respect of termination of services of the petitioner, letters dated 15.11.2018 (Annexure P-4) and 15.03.2019 (Annexure P-5) will be taken into consideration, no further order is required to be passed in the present writ petition.

Accordingly, the present writ petition is disposed of. 8.
