Challenge in the writ petition is to the order (Annexure P8) passed by the Financial Commissioner (Revenue), Punjab whereby he upheld appointment of Sarmej Singh (respondent No.3) as Lambardar of village mainly on the ground of his hereditary claim. In view of judgment delivered by this court in Sharif v. Financial Commissioner, Haryana and Others 2014(3) RCR (Civil) 431, hereditary claim cannot be a ground for appointing lambardar.

Under the circumstances, impugned order is hereby set aside. Matter is remitted to the Financial Commissioner (Revenue), Punjab for decision afresh in accordance with law.
