**** RAMESHWAR SINGH MALIK J. (ORAL) Petitioner seeks bail pending trial in FIR No. 45 dated 10.5.2014 under Sections 15/61/85 of the NDPS Act, registered at Police Station Sadar Abohar, District Fazilka. Notice to the Advocate General, Punjab.

On the asking of the Court, Mr. K.D.Sachdeva, Additional A.G. Punjab, accepts notice.

Learned counsel for the petitioner submits that petitioner is inside the jail for the last about one year. He further submits that allegations levelled against the petitioner are palpably wrong and based on a concocted story. Recovery from the petitioner is just marginal high than the commercial quantity. He concluded by submitting that since the prosecution has failed to conclude its evidence despite expiry of about one year, petitioner is entitled for the concession of bail pending trial. He prays for allowing the present petition.

Criminal Misc. No. M-9284 of 2015 On the other hand, learned counsel for the State, on instructions from ASI Gurpreet Singh, submits that one PW has already been examined and next date of hearing before the learned trial court is 25.5.2015 for examining 5 more PWs. He further submits that now trial will not take much time in its conclusion. He prays for dismissal of the petition.

Having heard the learned counsel for the parties, after careful perusal of the record of the case and giving thoughtful consideration to the contentions raised, this Court is of the considered opinion that in the given fact situation of the present case, petitioner has not been found entitled for the concession of bail pending trial.

At this stage, learned counsel for the petitioner seeks permission of the Court to withdraw the present petition. Dismissed as withdrawn, at this stage.
